NOGA TERMS & CONDITIONS 2009
THESE TERMS AND CONDITIONS CONSTITUTE A LEGAL AGREEMENT
BETWEEN YOU AND THE NOGA COMPANY, LLC.
PLEASE READ THIS AGREEMENT IN ITS ENTIRETY BEFORE YOU
CONTINUE TO REGISTER FOR ANY NOGA PROGRAM.
BY REGISTERING, YOU AGREE TO BE BOUND BY THE TERMS AND
CONDITIONS OF THIS AGREEMENT.

IF YOU DO NOT AGREE, PLEASE DO NOT REGISTER.

PARENTAL CONSENT:
My son/daughter is in good health and has my full permission to participate in a
NOGA soccer camp. He/She has had no previous sickness, illness, disease, or
bodily injury that is contradictory to such participation. I understand that soccer
is a contact sport, and that physical injury may occur during the course of
practice or games. I give my full permission for all such diagnostic and medical
procedures as may be deemed necessary by the examining physician for my
son/daughter.

I, for myself for personal representatives, assigns, heirs, and next of kin:
ACKNOWLEDGE and agree, that I understand the nature of NOGA’s camp
activities taking and that my son/daughter is qualified, in good health, and in
proper physical condition to participate in such activity.
I FULLY UNDERSTAND THAT: (a) ACTIVITIES AT NOGA COULD
INVOLVE RISKS AND DANGERS OF BODILY INJURY, ("RISKS"); (b)
these risks and dangers may be caused by my son/daughters own actions or
inaction’s, the actions or inaction’s of others participating in the activity; and I
FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL
RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES my son/daughter
may incur as a result of participation in the activity.
I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE THE
NOGA COMPANY LLC, their respective administrators, directors, agents,
officers, members, volunteers, and employees, other participants, any sponsors,
advertisers, and, if applicable, owner and lessors of premises on which the
Activity takes place, (each considered one of the "RELEASES" herein) FROM
ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY
ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART
BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE,
INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE
that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF
RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim
against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD
HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney
fees, loss, liability, damage, or cost which may incur as the result of such claim.
Permission is also granted for NOGA to use any individual video tape or
photographs taken at the camp in conjunction with publicity.

PRICE AND PAYMENTS:
• Payments can be made by check, Discover, Visa, MasterCard, or American
Express.
• Full payment must be made upon registration unless the camp specifically
offers other payment options
• The price that you pay is entirely dependent upon when your payment is
made. The price scale is itemized on the NOGA web site.
• The earlier registration is made the more that can be saved.

COUPONS:
Where coupons are available for camps the following applies:
• Only one coupon is allowable per individual registration.
• Special volume discounts for club sign up days or complete teams are also
available. Please call our Head Office for further details.

REFUND POLICY:

TUITION PROTECTION PLAN:
NOGA created the Tuition Protection Plan (TPP) to provide families with peace of
mind if they risk seeing plans change and must cancel registrations at a later
date. Tuition Protection must be subscribed to at the time of enrollment and may
not be added at a later date.

The cost for Tuition Protection is as follows:
Academy Camp . . . . . . . . . . . . . . . . . . . . . . . . . . $25.00 per player/week
Community Camp . . . . . . . . . . . . . . . . . . . . . . . . $10.00 per player/week

REFUND ELIGIBILITY

With the Tuition Protection Plan:
Cancellations can be made for any reason, at any time, up to the first day of
camp. With Tuition Protection you will receive a full refund of all monies paid.
(All refunds exclude the tuition protection fee)

Without the Tuition Protection Plan:
Cancellations up to the first day of camp will result in the provision of a CREDIT
NOTE for the following year, less $125.00 deposit fee for any Academy camp
and less $50.00 deposit fee for any Community Camp.

In all cases:
• No refunds are issued for no-shows, late arrivals, early withdrawals,
absences, power failures or camper dismissals for disciplinary reasons.
• Falsifying information is grounds for dismissal without refund.

How to Request a Refund
All requests for refunds must be made in writing via regular post attention NOGA
Cancellation Dept. P.O. Box 262, Garden City NY 11530 or via email to
NOGANeil@aol.com or, via Fax attention Cancellation Dept. to (516) 489-3970.
All refunds will take 14 days to process.

Camp Cancellation and Poor Weather
NOGA reserves the right to cancel or change a camp or location if participation
numbers are not adequate. You may select an alternative session date or request
a full cash refund of tuition paid should such a situation occur.
• All Academy camps take place rain or shine.
• At community camps NOGA makes every effort to make up any lost time
due to poor weather conditions but there are no guarantees that in the
event of bad weather NOGA will be able to complete all time that may be
lost.

TRANSFERRING REGISTRATIONS:
• NOGA Registrations ARE transferable.
• Transfers must be in writing and must be received no later than 15
days prior to the start of the camp week.
• Transfers later than 15 days prior to the start of a camp may incur a $50
administration fee.

INSURANCE:
Supplementary accident insurance is provided for each NOGA camper. This
insurance covers ONLY medical costs resulting from injury at camp which are
not covered by your own medical insurance and which are evaluated as
justifiable by the NOGA insurance carrier.

VITAL INFORMATION PACKAGE:
• The vital information packet includes everything parents need to prepare
for camp, including campus information and directions,
medical/permission forms and general camp information.
